Through this privacy policy, our company aims to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, this privacy policy informs data subjects about their rights.

As the controller responsible for processing, O.KOON GmbH has implemented numerous technical and organisational measures to ensure the most complete possible protection of personal data processed via this website. Nevertheless, internet-based data transmissions can fundamentally have security vulnerabilities, meaning that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us through alternative means, for example, by telephone.

1. Definitions
O.KOON GmbH’s privacy policy is based on the terms used by the European legislator when enacting the General Data Protection Regulation (GDPR). Our privacy policy should be easy to read and understand for the public as well as for our customers and business partners. To ensure this, we would like to explain the terms used in advance.

Among other things, we use the following terms in this privacy policy:

a) Personal data
Personal data means any information relating to an identified or identifiable natural person (hereinafter “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

b) Data subject
A data subject is any identified or identifiable natural person whose personal data is processed by the controller.

c) Processing
Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

d) Restriction of processing
Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.

e) Profiling
Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

f) Pseudonymisation
Pseudonymisation means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

g) Controller or controller responsible for the processing
Controller or controller responsible for the processing means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

h) Processor
Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

i) Recipient
Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

j) Third party
Third party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

k) Consent
Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3. Cookies
The websites of O.KOON GmbH use cookies. Cookies are text files that are stored on a computer system via an internet browser.

By means of a cookie, the information and offers on our website can be optimised in the user’s interest. Cookies enable us, as already mentioned, to recognise the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to enter their access data each time they visit the website, because this is done by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online shop. The online shop remembers the items that a customer has placed in the virtual shopping cart via a cookie.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the internet browser used and thus permanently object to the setting of cookies. Furthermore, already set cookies can be deleted at any time via an internet browser or other software programs. This is possible in all common internet browsers. 4. Collection of general data and information
The O.KOON GmbH website collects a series of general data and information with each call of the website by a data subject or an automated system. This general data and information are stored in the log files of the server. The following can be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of an access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information that serve to avert danger in the event of attacks on our information technology systems.

When using these general data and information, O.KOON GmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimise the content of our website and the advertising for it, (3) ensure the permanent functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. These anonymously collected data and information are therefore evaluated by O.KOON GmbH on the one hand statistically and furthermore with the aim of increasing data protection and data security in our company, in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

5. Registration on our website
The data subject has the possibility to register on the website of the controller by providing personal data. Which personal data are transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for disclosure to one or more processors, for example a parcel service provider, who also uses the personal data exclusively for internal use attributable to the controller.

By registering on the website of the controller, the IP address assigned by the data subject’s internet service provider (ISP), the date, and the time of registration are also stored. The storage of this data takes place against the background that this is the only way to prevent misuse of our services, and if necessary, this data enables criminal offenses to be investigated. In this respect, the storage of this data is necessary to secure the controller. As a matter of principle, this data is not passed on to third parties, unless there is a legal obligation to do so or the disclosure serves criminal prosecution.

The registration of the data subject with the voluntary provision of personal data enables the controller to offer the data subject content or services that, due to their nature, can only be offered to registered users. Registered persons are free to modify the personal data provided during registration at any time or to have them completely deleted from the controller’s database.

The controller shall provide any data subject with information at any time upon request about what personal data relating to the data subject is stored. Furthermore, the controller shall correct or erase personal data at the request or indication of the data subject, provided that no legal retention obligations oppose this. All employees of the controller are available to the data subject as contact persons in this context.

6. Subscription to our newsletter
On the O.KOON GmbH website, users are given the opportunity to subscribe to our company's newsletter. Which personal data are transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.

O.KOON GmbH informs its customers and business partners at regular intervals about company offers by means of a newsletter. The newsletter of our company can generally only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for newsletter dispatch. For legal reasons, a confirmation email will be sent to the email address entered for the first time by a data subject for newsletter dispatch using the double opt-in procedure. This confirmation email serves to verify whether the owner of the email address, as the data subject, has authorised the receipt of the newsletter.

When subscribing to the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary to be able to trace the (possible) misuse of a data subject’s email address at a later date and therefore serves to legally protect the controller.

The personal data collected as part of a registration for the newsletter will be used exclusively for sending our newsletter. Furthermore, newsletter subscribers could be informed by email if this is necessary for the operation of the newsletter service or a related registration, as could be the case in the event of changes to the newsletter offer or a change in technical circumstances. The personal data collected as part of the newsletter service will not be passed on to third parties. The subscription to our newsletter can be terminated by the data subject at any time. The consent to the storage of personal data that the data subject has given us for newsletter dispatch can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in every newsletter. There is also the possibility to unsubscribe from newsletter dispatch directly on the controller’s website at any time or to inform the controller in another way.

7. Newsletter tracking
The newsletters of O.KOON GmbH contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails that are sent in HTML format to enable log file recording and log file analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Based on the embedded tracking pixel, O.KOON GmbH can see whether and when an email was opened by a data subject and which links in the email were clicked by the data subject.

Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller in order to optimize newsletter dispatch and to adapt the content of future newsletters even better to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled to revoke the relevant separate declaration of consent given via the double opt-in procedure at any time. After a revocation, this personal data will be deleted by the controller. O.KOON GmbH automatically interprets an unsubscription from the newsletter as a revocation.

8. Contact possibility via the website
Due to legal regulations, the O.KOON GmbH website contains information that enables quick electronic contact with our company as well as direct communication with us, which also includes a general address for so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject will be stored automatically.

Such personal data voluntarily transmitted by a data subject to the controller will be stored for the purpose of processing or contacting the data subject. This personal data will not be passed on to third parties.

9. Comment function in the blog on the website
O.KOON GmbH offers users the possibility to leave individual comments on individual blog posts on a blog located on the website of the controller. A blog is a portal maintained on a website, usually publicly accessible, in which one or more persons, called bloggers or web bloggers, can post articles or write down thoughts in so-called blog posts. Blog posts can usually be commented on by third parties.

If a data subject leaves a comment in the blog published on this website, in addition to the comments left by the data subject, information on the time of entry of the comments as well as the username (pseudonym) chosen by the data subject will be stored and published. Furthermore, the IP address assigned by the internet service provider (ISP) of the data subject will be logged. This storage of the IP address is for security reasons and in the event that the data subject violates the rights of third parties or posts illegal content through a comment made. The storage of this personal data is therefore in the controller's own interest, so that the controller could exculpate himself in the event of a legal violation. This collected personal data will not be passed on to third parties, unless such disclosure is legally required or serves the legal defense of the controller.

10. Routine deletion and blocking of personal data
The controller processes and stores personal data of the data subject only for the period necessary to achieve the storage purpose or as far as this has been provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.

If the storage purpose ceases to apply or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with legal provisions.

11. Rights of the data subject

a) Right to confirmation
Every data subject has the right granted by the European legislator to obtain from the controller confirmation as to whether personal data concerning him or her are being processed. If a data subject wishes to exercise this right to confirmation, he or she may, at any time, contact an employee of the controller.

b) Right to information
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain at any time and free of charge from the controller information about the personal data stored about him or her and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:

- The purposes of the processing
- The categories of personal data being processed
- The recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
- If possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
- The existence of the right to request from the controller rectification or erasure of personal data or restriction of processing concerning the data subject or to object to such processing
- The existence of the right to lodge a complaint with a supervisory authority
where the personal data are not collected from the data subject: Any available information as to their source
the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

Furthermore, the data subject has the right to information as to whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards relating to the transfer.

If a data subject wishes to exercise this right to information, they can contact an employee of the controller at any time.

c) Right to rectification
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to demand the immediate rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right, taking into account the purposes of the processing, to have incomplete personal data completed – including by means of a supplementary statement.

If a data subject wishes to exercise this right to rectification, they can contact an employee of the controller at any time.

d) Right to erasure (right to be forgotten)
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to demand from the controller that personal data concerning them be deleted without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:

The personal data was collected or otherwise processed for purposes for which it is no longer necessary.
The data subject withdraws their consent on which the processing was based pursuant to Art. 6 para. 1 lit. a GDPR or Art. 9 para. 2 lit. a GDPR, and there is no other legal basis for the processing.
The data subject objects to the processing pursuant to Art. 21 para. 1 GDPR, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21 para. 2 GDPR.
The personal data was processed unlawfully.
The erasure of personal data is necessary for compliance with a legal obligation under Union law or Member State law to which the controller is subject.
The personal data was collected in relation to information society services offered pursuant to Art. 8 para. 1 GDPR.
If one of the above reasons applies and a data subject wishes to initiate the erasure of personal data stored at O.KOON GmbH, they can contact an employee of the controller at any time. The employee of O.KOON GmbH will arrange for the erasure request to be complied with without delay.

If O.KOON GmbH has made the personal data public and our company, as the controller, is obliged to erase the personal data pursuant to Art. 17 para. 1 GDPR, O.KOON GmbH shall take reasonable measures, including technical ones, considering the available technology and the costs of implementation, to inform other controllers who are processing the published personal data that the data subject has requested the erasure by such other controllers of any links to, or copy or replication of, those personal data, insofar as processing is not necessary. The employee of O.KOON GmbH will arrange for the necessary action in individual cases.

e) Right to restriction of processing
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to demand from the controller the restriction of processing if one of the following conditions is met:

The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful, and the data subject opposes the erasure of the personal data and requests instead the restriction of its use.
The controller no longer needs the personal data for the purposes of processing, but the data subject requires it for the establishment, exercise or defence of legal claims.
The data subject has objected to processing pursuant to Art. 21 para. 1 GDPR, and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.
If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored at O.KOON GmbH, they can contact an employee of the controller at any time. The employee of O.KOON GmbH will arrange for the restriction of processing.

f) Right to data portability
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used and machine-readable format. They also have the right to transmit that data to another controller without hindrance from the controller to which the personal data has been provided, where the processing is based on consent pursuant to Art. 6 para. 1 lit. a GDPR or Art. 9 para. 2 lit. a GDPR or on a contract pursuant to Art. 6 para. 1 lit. b GDPR and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, when exercising their right to data portability pursuant to Art. 20 para. 1 GDPR, the data subject has the right to have personal data transmitted directly from one controller to another, where technically feasible and where this does not adversely affect the rights and freedoms of others.

To assert the right to data portability, the data subject can contact an employee of O.KOON GmbH at any time.

g) Right to object
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to object, on grounds relating to their particular situation, at any time to processing of personal data concerning them which is based on Art. 6 para. 1 lit. e or f GDPR. This also applies to profiling based on these provisions.

O.KOON GmbH will no longer process the personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If O.KOON GmbH processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for the purpose of such marketing. This also applies to profiling, insofar as it is related to such direct marketing. If the data subject objects to O.KOON GmbH processing for direct marketing purposes, O.KOON GmbH will no longer process the personal data for these purposes.

Furthermore, the data subject has the right, on grounds relating to their particular situation, to object to processing of personal data concerning them which is carried out by O.KOON GmbH for scientific or historical research purposes or statistical purposes pursuant to Art. 89 para. 1 GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

To exercise the right to object, the data subject can contact any employee of O.KOON GmbH or another employee directly. The data subject is also free, in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to exercise their right to object by automated means using technical specifications.

h) Automated individual decision-making, including profiling
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations not to be subject to a decision based solely on automated processing—including profiling—which produces legal effects concerning them or similarly significantly affects them, provided that the decision (1) is not necessary for entering into, or performance of, a contract between the data subject and a controller, or (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is based on the data subject's explicit consent.

If the decision (1) is necessary for entering into, or performance of, a contract between the data subject and a controller, or (2) is based on the data subject's explicit consent, O.KOON GmbH shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express their point of view and to contest the decision.

If the data subject wishes to assert rights relating to automated decisions, they can contact an employee of the controller at any time.

i) Right to withdraw data protection consent
Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to withdraw consent to the processing of personal data at any time.

If the data subject wishes to exercise their right to withdraw consent, they can contact an employee of the controller at any time.

12. Data protection in applications and the application process
The controller collects and processes the personal data of applicants for the purpose of handling the application process. The processing can also be done electronically. This is particularly the case if an applicant submits corresponding application documents electronically, for example by email or via a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with legal provisions. If no employment contract is concluded with the applicant by the controller, the application documents will be automatically deleted two months after the announcement of the rejection decision, provided that no other legitimate interests of the controller stand in the way of deletion. Other legitimate interests in this sense include, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

13. Data protection provisions regarding the use of Facebook
The controller has integrated components of the Facebook company on this website. Facebook is a social network.

A social network is a social meeting place operated on the Internet, an online community that generally allows users to communicate with each other and interact in virtual space. A social network can serve as a platform for sharing opinions and experiences or enables the internet community to provide personal or company-related information. Facebook allows users of the social network, among other things, to create private profiles, upload photos and network through friend requests.

The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. The controller for the processing of personal data, if a data subject lives outside the USA or Canada, is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time one of the individual pages of this website, which is operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, is called up, the internet browser on the information technology system of the data subject is automatically prompted by the respective Facebook component to download a display of the corresponding Facebook component from Facebook. An overview of all Facebook plug-ins can be accessed here. Within the scope of this technical procedure, Facebook gains knowledge of which specific sub-page of our website is visited by the data subject.

If the data subject is simultaneously logged into Facebook, Facebook recognizes with each call of our website by the data subject and during the entire duration of the respective stay on our website, which specific sub-page of our website the data subject visits. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject activates one of the Facebook buttons integrated on our website, for example the "Like" button, or if the data subject posts a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores this personal data.

Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is simultaneously logged into Facebook at the time of calling up our website; this takes place regardless of whether the data subject clicks on the Facebook component or not. 14. Data protection provisions regarding the use of Google Analytics (with anonymisation function)
The controller has integrated the Google Analytics component (with anonymisation function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, gathering and evaluation of data about the behaviour of visitors to websites. A web analysis service collects, among other things, data about which website a data subject came from to a website (so-called referrer), which sub-pages of the website were accessed or how often and for what duration a sub-page was viewed. Web analysis is mainly used to optimise a website and for the cost-benefit analysis of internet advertising.

The operating company of the Google Analytics component is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

The controller uses the "_gat._anonymizeIp" add-on for web analysis via Google Analytics. By means of this add-on, the IP address of the data subject's internet connection is shortened and anonymised by Google if access to our websites takes place from a Member State of the European Union or from another contracting state to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyse visitor flows on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our websites, and to provide other services associated with the use of our website.

Google Analytics places a cookie on the data subject's information technology system. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyse the use of our website. With each call of one of the individual pages of this website, which is operated by the controller and on which a Google Analytics component has been integrated, the internet browser on the information technology system of the data subject is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis.

Within the scope of this technical process, Google receives knowledge about personal data, such as the IP address of the data subject, which Google uses, among other things, to track the origin of visitors and clicks and subsequently enable commission settlements.

Through the cookie, personal information, such as the access time, the location from which access originated, and the frequency of visits to our website by the data subject, is stored. With each visit to our website, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass on this personal data collected through the technical process to third parties.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the internet browser used, as already described above, and thus permanently object to the setting of cookies.
